(1.1) "SAMPATH REWARDS" means the rewards programme established by SAMPATH BANK PLC a banking company duly incorporated in Sri Lanka bearing registration No. PQ 144 and having its registered Office at No 110, Sir James Peiris Mawatha, Colombo 02 and subject to these Terms and Conditions.
(1.2) "SAMPATH REWARDS Account" means the account created by a Basic Sampath Credit Cardholder/Cardmember holding a valid Credit card, by registering in the loyalty.sampathbank.lk/ultrarewards Web Site, reflecting all transactions relating to SAMPATH REWARDS for a particular SAMPATH BANK REWARDS Account holder in SAMPATH BANKS’s records, including earned SAMPATH REWARDS Points, adjusted SAMPATH REWARDS Points, bonus SAMPATH REWARDS Points, redeemed SAMPATH REWARDS Points and expired SAMPATH REWARDS Points.
(1.3) "SAMPATH REWARDS Account holder" means, in relation to each SAMPATH REWARDS Relationship, the Basic Credit Cardholder/Cardmember or, where there is more than one person comprising the customer, the first named signatory holding such relationship.
(1.4) "SAMPATH REWARDS Booking Policy" means the booking policy to redeem SAMPATH REWARDS Points as published from time to time on the SAMPATH REWARDS Website.
(1.5) "SAMPATH REWARDS POINTS" means the reward points credited/debited to the SAMPATH REWARDS Account as a result of any SAMPATH REWARDS Relationship or SAMPATH REWARDS Transaction.
(1.6) "SAMPATH REWARDS Statement" has the meaning set out in Clause 5.1.
(1.7) “RELATIONSHIP” includes without limitation, personal loan, car loan, investment products, banc assurance, current / savings account, fixed deposit, debit card or credit card, mortgage loan and electronic channels), and which SAMPATH BANK credit card transactions (a “SAMPATH REWARDS Transaction”)
The following terms and conditions ("Terms and Conditions") are applicable to SAMPATH REWARDS and, by becoming a SAMPATH REWARDS Account holder, you agree to be bound by the Terms and Conditions, as the same may be amended, supplemented, updated, replaced or otherwise varied by SAMPATH BANK from time to time and you represent and warrant that you are aged at least 18 years.
(2.1) All determinations to be made under SAMPATH REWARDS shall be made by SAMPATH BANK, at its absolute discretion and on the basis of SAMPATH BANK Records, and each such determination shall be final, conclusive and binding on the SAMPATH REWARDS Account holder, save in the absence of manifest error made known to SAMPATH BANK by the SAMPATH REWARDS Account holder in accordance with the time limit set out in Clause 5.2.
(2.1.1) SAMPATH BANK reserves the right, at any time, at its absolute discretion, without notice and without liability whatsoever on its part, to supplement, amend, replace, delete or otherwise vary any of the Terms and Conditions, including the Schedules, as well as the terms and conditions of any other policy referred to in the Terms and Conditions, and to change, vary, modify, terminate or cancel SAMPATH REWARDS or any of its benefits or features, or otherwise do any other act with respect to the whole or any part of SAMPATH REWARDS, or to withdraw or change the membership criteria and/or to limit or change the value / validity of SAMPATH REWARDS and/or the manner of redemption on, SAMPATH REWARDS. By becoming a SAMPATH REWARDS Account holder, you acknowledge and accept that the mentioned foregoing acts may diminish the redemption value of SAMPATH REWARDS Points already earned and agree you shall not be entitled to claim compensation for any such loss in value.
(2.1.2) By becoming a SAMPATH REWARDS Account holder, you acknowledge and agree that the Terms and Conditions, as well as other information regarding SAMPATH REWARDS, are published and may be accessed online at loyalty.sampathbank.lk/ultrarewards , and you acknowledge and agree to keep yourself updated with the most up to date and current version.
(2.2) In addition to these Terms and Conditions, each SAMPATH REWARDS Account holder continues to be subject to the General Terms and Conditions of Account Opening and the terms and conditions applicable to the relevant SAMPATH BANK product which made him/her eligible for participation in SAMPATH REWARDS, including without limitation, personal loan, car loan, mortgage loan, investment products, bancassurance, credit card, debit card, current account, savings account, fixed deposit, electronic transaction channels and such other terms and conditions as may be included by SAMPATH REWARDS from time to time, which are incorporated by reference herein and copies of which shall be provided to the SAMPATH REWARDS Account holder upon request.
Membership in SAMPATH REWARDS is automatic for each SAMPATH REWARDS customer holding a SAMPATH REWARDS Relationship and who is in of good standing and anything not in breach of any terms and conditions relating to such SAMPATH REWARDS Relationship.
(3.1) The SAMPATH REWARDS membership is limited to the Basic Credit Cardholder/Cardmember (i.e. first named) customer Account holder the Main Sampath Credit Card Account holder). Membership qualifies the SAMPATH REWARDS Account holder to benefit from special offers and promotions which may be provided by SAMPATH REWARDS from time to time, provided the SAMPATH REWARDS Relationship is in good standing and provided there has been satisfactory conduct of the SAMPATH REWARDS customer’s account and/or Sampath Credit Card Account.
(3.2) Membership is also subject to the qualifications and conditions (including annual SAMPATH REWARDS Points accrual limits, if any) as determined by SAMPATH BANK SAMPATH REWARDS. SAMPATH BANK reserves the right, at any time and without notice, to impose a validity period on membership, as well as to extend or reduce the same.
(3.3) In the event that a customer account signatory is removed from the relevant SAMPATH REWARDS Relationship, then such signatory is no longer eligible to participate in SAMPATH REWARDS.
(3.4) SAMPATH BANK reserves the right, at any time, at its absolute discretion, without notice and without liability whatsoever on its part, to withdraw or discontinue any one or more of the SAMPATH REWARDS Relationships or SAMPATH REWARDS Transactions and terminate membership on of SAMPATH REWARDS and revoke any accrued SAMPATH REWARDS Points.
(3.5) Membership on of SAMPATH REWARDS is automatically terminated upon the death, bankruptcy, or unsatisfactory conduct of the account or relationship of the Basic SAMPATH REWARDS Relationship holder.
(3.6) Upon termination of membership, all SAMPATH REWARDS Points accrued in the SAMPATH REWARDS Account shall be immediately forfeited and cancelled by SAMPATH BANK. SAMPATH BANK may also delete the terminated SAMPATH REWARDS Account on the SAMPATH REWARDS Website.
(4.1) SAMPATH BANK shall determine, from time to time, at its absolute discretion, which SAMPATH REWARDS Relationships (including, without limitation, personal loan, car loan, investment products, bancassurance, current / savings account, fixed deposit, debit card or credit card, mortgage loan and electronic channels), and which SAMPATH BANK credit card transactions (a “SAMPATH REWARDS Transaction”) are eligible for inclusion in SAMPATH REWARDS and how many SAMPATH REWARDS Points each will earn, the associated limits on earnings as well as the number of SAMPATH REWARDS Points required for redemption of SAMPATH REWARDS. In case of a reversal of any SAMPATH REWARDS Transaction, SAMPATH REWARDS Points credited to the SAMPATH REWARDS Account as a result of such SAMPATH REWARDS Transaction will be deducted from the accrued SAMPATH REWARDS Points credit balance. Debits to the SAMPATH REWARDS Account unrelated to any reversed SAMPATH REWARDS Transaction will reduce the accrued SAMPATH REWARDS credit balance as per the calculation criteria set out for a particular SAMPATH REWARDS Relationship. No SAMPATH REWARDS Points may be earned during a promotion, special offer or other black-out period or through the redemption of any SAMPATH REWARDS Points as determined by SAMPATH BANK from time to time and at its absolute discretion.
(4.2) Pursuant to Clause 4.1, SAMPATH REWARDS Points are earned for each of the SAMPATH REWARDS Relationship or SAMPATH REWARDS Transactions subject to SAMPATH REWARDS earning criteria, and no SAMPATH REWARDS Points shall be awarded retroactively. Schedule B sets out the list of further conditions attached to the earning of SAMPATH REWARDS Points in relation to each type of SAMPATH REWARDS Relationship or SAMPATH REWARDS Transaction. SAMPATH REWARDS Points are calculated by rounding down the transaction value to the nearest integer.
(4.3) SAMPATH REWARDS Points are not assignable or otherwise transferable, and are not capable of being mortgaged, charged or pledged, nor can SAMPATH REWARDS Points of one SAMPATH REWARDS Relationship holder or SAMPATH REWARDS Transaction holder be combined with those of another.
(4.4) In the event of a change to the status of a SAMPATH REWARDS Relationship (such as an upgrade or downgrade), the future calculation of SAMPATH REWARDS Points shall be adjusted by SAMPATH BANK accordingly.
(4.5) SAMPATH REWARDS Points are valid only for a period of two (2) years from the start of the month during which such SAMPATH REWARDS Points are earned. Unless used prior to the expiration date, SAMPATH REWARDS Points shall expire on such date. Upon expiration, unused SAMPATH REWARDS Points will be removed from the SAMPATH REWARDS Account as of the expiration date and cannot be re-credited. It is the SAMPATH REWARDS Relationship or SAMPATH REWARDS Transaction holder's responsibility to be aware of both the number of SAMPATH REWARDS Points outstanding in his account and their expiration date. This can be monitored at any time online on the SAMPATH REWARDS Website.
(5.1) A record of SAMPATH REWARDS activity for each SAMPATH REWARDS Relationship will be mailed electronically or otherwise made electronically available in the form of an electronic or online statement (“SAMPATH REWARDS Statement”) to the SAMPATH REWARDS Account holder on a regular basis, the regularity to be determined by SAMPATH BANK at its absolute discretion. SAMPATHCARDS ULTRA REAWARD Points shall be transferred on a periodic basis as per the SAMPATHCARDS ULTRA REAWARDS Relationship or SAMPATHCARDS ULTRA REAWARDS Transaction activity into the SAMPATHCARDS ULTRA REAWARDS Account for the purpose of accruing SAMPATHCARDS ULTRA REAWARD Points. All the SAMPATHCARDS ULTRA REAWARD Points shall accrue and expire as described in these Terms and Conditions and any additional terms and conditions contained in the SAMPATHCARDS ULTRA REAWARDS Statement. A SAMPATHCARDS ULTRA REAWARDS Relationship holder may access a copy of his/her SAMPATHCARDS ULTRA REAWARDS Statement online on the SAMPATHCARDS ULTRA REAWARDS Website.
(5.2) Any manifest error in the SAMPATHCARDS ULTRA REAWARDS Statement must be reported to SAMPATH BANK within fourteen (14) days of the SAMPATHCARDS ULTRA REAWARDS Statement date.
(6.1) Provided that the SAMPATH REWARDS Relationship is active and in good standing, and subject to the approval of SAMPATH BANK, SAMPATH REWARDS Points may be redeemed (i) in exchange for air tickets, hotel stays or other specific merchandise, as may be published from time to time on the SAMPATH REWARDS Website, if available for purchase, (ii) vouchers for any of the items of merchandise mentioned in (i) above, or (iii) to off-set specified SAMPATH REWARDS fees and/or charges, as determined by SAMPATH BANK.
(6.2) Only SAMPATH REWARDS Points that are accrued registered in and credited to the SAMPATH REWARDS Account, at the time of redemption, are eligible for redemption as determined conclusively by SAMPATH BANK in accordance with the SAMPATH REWARDS and in the absence of manifest error.
(6.3) he redemption of SAMPATH REWARDS Points by each SAMPATH REWARDS Account holder is effected by logging onto and using the SAMPATH REWARDS Website. Any instructions conveyed by the SAMPATH REWARDS Relationship holder will be governed by the terms and conditions of the respective mode of redemption. SAMPATH BANK, at its absolute discretion, may act upon the instructions received through these modes of redemption.
(6.4) Only the Basic (i.e. first named) signatory is eligible to redeem SAMPATH REWARDS Points. Additional SAMPATH REWARDS Points, however, may be purchased for a non-refundable fee if made available and agreed by SAMPATH BANK. – eg customer wants to purchase an Air ticket but the accrued points are not sufficient. Then the customer can utilize the available credit limit to purchase Ultra Rewards.
(6.5) In the case where SAMPATH REWARDS Points are subtracted from the SAMPATH REWARDS Account and it reduces or eliminates the accumulated SAMPATH REWARDS Points resulting in a negative SAMPATH REWARDS Account balance, SAMPATH BANK may, at its absolute discretion, either suspend delivery of the SAMPATH REWARDS Points or permit the delivery of the SAMPATH REWARDS Point and either debit the equivalent cash value of the negative balance or use any subsequently accrued SAMPATH REWARDS Points to offset the negative SAMPATH REWARDS Account balance until such balance has returned to zero or positive.
(6.6) Once issued, redemption of air tickets, hotel stays, other merchandise and vouchers are not exchangeable, returnable, refundable, or redeemable for cash or credit, nor will they be replaced in the event of loss, damage or destruction. Once submitted, an order for a redemption of air tickets, hotel stays or other merchandise or a voucher cannot be cancelled, revoked, transferred or changed by the SAMPATH REWARDS Account holder in any manner.
(6.7) Redemption of air tickets, hotel stays and other merchandise or the issue of vouchers for the same are sent to the SAMPATH REWARDS Account holder’s email ID or billing address in SAMPATH REWARDS Records. If the SAMPATH REWARDS Account holder wishes to have them sent to a different e-mail ID or delivery address, the e-mail ID or delivery address contained in the SAMPATH REWARDS Account holder’s account profile on the SAMPATH REWARDS Website must be updated prior to redeeming any SAMPATH REWARDS Points. Sampath Bank will not be responsible for any redemption of air tickets, hotel stays or other merchandise or the issue of a voucher sent to the wrong e-mail ID or delivery address or returned as a result of the SAMPATH REWARDS Account holder’s failure to update his/her account profile information on the SAMPATH REWARDS Website.
(6.8) Should the goods or services being the subject of a SAMPATH REWARDS Reward be received in a damaged or defective condition, the SAMPATH REWARDS Account holder must notify the relevant supplier of such damage or defect within the stipulated number of days as mentioned in the purchase receipt. SAMPATH BANK shall use its reasonable efforts to convey the SAMPATH REWARDS Account holder’s complaint to the supplier and arrange, whenever possible, for an appropriate replacement of comparable nature and value as determined by SAMPATH BANK. Notwithstanding the foregoing, SAMPATH BANK shall not be held responsible in any manner whatsoever for damaged or defective goods or services the subject of a SAMPATH REWARDS.
All SAMPATH REWARDS Points of a SAMPATH REWARDS Account holder shall be forfeited and shall be cancelled immediately and no additional or unprocessed redemption requests of SAMPATH REWARDS Points shall accrue in the SAMPATH REWARDS Account in the following circumstances: (a) the SAMPATH REWARDS Relationship has been closed or is not in good standing (as determined by SAMPATH BANK at its absolute discretion); (b) breach of any of these Terms and Conditions and/or any other terms and conditions expressly incorporated by reference in these Terms and Conditions; or (c) any other event or circumstance exists, which, in the absolute discretion of SAMPATH BANK, should result in such forfeiture.
(8.1) SAMPATH BANK shall not be liable for losses, damages, expenses, claims or any other liability whatsoever, whether direct, indirect, consequential, incidental, special or punitive, sustained by a SAMPATH REWARDS Account holder as a result of the availability, non-availability, maintenance or operation of the SAMPATH REWARDS Website, the redemption of SAMPATH REWARDS Points, the possession and/or use of a SAMPATH REWARDS , or in any other way arising from membership in, or in connection with, SAMPATH REWARDS, nor shall UAB SAMPATH BANK be responsible or held liable for any amounts payable by a SAMPATH REWARDS Account holder to any third party arising out of the purchase, supply, quality, installation, use or otherwise, of a SAMPATH REWARDS, or of any negligence, breach of statutory or other duty on the part of SAMPATH BANK, any supplier, issuer, merchant and/or other person associated in any way, directly or indirectly, with SAMPATH REWARDS.
(8.2) SAMPATH BANK makes no representation and provides no warranty whatsoever, expressed or implied, and undertakes and assumes no liability whatsoever, in respect of the quality of any goods or services which are the subject of a SAMPATH REWARDS Reward or their suitability or fitness for any use or purpose. All goods or services which are the subject of a SAMPATH REWARDS shall be accepted by the SAMPATH REWARDS Relationship holder at his/her own risk and peril.
In the event of a breach by a SAMPATH REWARDS Account holder of these Terms and Conditions or of any applicable provisions in any terms and conditions incorporated by reference in these Terms and Conditions, or in the event of the failure on the part of a SAMPATH REWARDS Account holder to pay for any outstanding amounts to SAMPATH BANK within the prescribed time set by SAMPATH BANK or for any other reason whatsoever, SAMPATH BANK reserves the right, at its absolute discretion, to:
(9.1) terminate the SAMPATH REWARDS Account holder’s membership on SAMPATH REWARDS and close his/her SAMPATH REWARDS Account;
(9.2) refuse to award any future SAMPATH REWARDS Points;
(9.3) withdraw any SAMPATH REWARDS Points earned; and/or
(9.4) refuse to permit the redemption of any SAMPATH REWARDS Points.
Such action by SAMPATH BANK in respect of a SAMPATH REWARDS Account holder may result, in SAMPATH BANK’s absolute discretion, in the forfeiture of all of the SAMPATH REWARDS Account holder’s SAMPATH REWARDS Points.
These Terms and Conditions are governed by the laws of the Democratic Socialist Republic of Sri Lanka.
SCHEDULE A
The SAMPATH REWARDS Earning Table will be mailed electronically and/or published on the SAMPATH REWARDS Website, and may be amended, supplemented, updated, replaced or otherwise varied from time to time by SAMPATH BANK, at its absolute discretion without prior notice. The SAMPATH REWARDS Earning Table sets out the specific terms and conditions relating to each SAMPATH REWARDS Relationship and each SAMPATH REWARDS Transaction and such table, terms and conditions shall be incorporated by reference in these Terms and Conditions.
SCHEDULE B
For Credit Cards
No SAMPATH REWARDS Points shall be earned for SAMPATH BANK credit card transactions related to the following: (a) fees, charges and interest; (b) any payments or amounts deposited or credited to the card account; (c) transactions that SAMPATH BANK determines, in its absolute discretion, are disputed, erroneous, unauthorized, illegal and/or fraudulent; (d) ATM withdrawals ,Cash Advances and Casino transactions both local and abroad; (e) Fuel transactions and (f)any other transactions that SAMPATH BANK may include on this list from time to time.
For Debit Cards
No SAMPATH REWARDS Points shall be earned for SAMPATH BANK Debit card transactions.
